We respect the privacy/protection of personal data of anyone who visits or registers on www.cineland.bg (“Site” or “Site”) or our mobile phone applications (Cineland on iSO Apple’s App store and Cineland on Google Play – hereinafter referred to as “Mobile Applications”) and who uses the services we provide from the Site, Mobile Applications in our cinema complexes and through our customer service services (our “Services”) and we are committed to ensuring safe online use.

 

1. PURPOSE OF THIS POLICY

This Privacy Policy/Privacy Policy (“Privacy Policy”) explains our approach to any personal information/personal data that we may collect from you or that we have received about you from a third party, including from someone who has bought a gift for you, and to the purposes for and on the basis of which we process your personal data. This Privacy Policy also sets out your rights in relation to the processing we do of your personal data.

This Privacy Policy will inform you about the nature of the personal information about you that is processed by us and how you can request that we delete, update, transfer and/or provide you with access to it.

This Privacy Policy is designed to help you make informed decisions when using the Site, Mobile Applications and our Services. Please take a moment to read and understand it.

Please also note that this Privacy Policy applies only to the use of personal data received by you; it does not apply to your personal data collected during your communication with third parties.

The privacy policy may change from time to time, so please check it regularly.

2. WHO ARE WE AND WHAT DO WE DO?

The Site and our services are operated by “Cineland” OOD, (“Cineland”, “we”, “us” or “our”).

Cineland is the data controller responsible for your personal data obtained in connection with the provision for use of our Site, Mobile Applications and Services.

Cineland Ltd. is a limited liability company, established and registered under the laws of the Republic of Bulgaria, with EIK 203209199, with its registered office and management address in the city of Sofia 1000, Sredets district, 47 “Hristo Belchev” street, floor 3, apartment. 7.

4. WHAT PERSONAL DATA DO WE COLLECT AND HOW DO WE USE IT?

We receive your personal data from the following sources:

• directly from you, or in person (in cinemas or otherwise), through our site and mobile applications, on our social media pages, or when you contact us or someone contacts us on your behalf;

• through automated technologies, such as CCTV or other recording systems, cookies, server logs and other similar technologies;

• from our group companies and third party service providers in the process of providing their services to us in connection with your use of our Site, Mobile Applications and Services; Please see section 7 “Who do we share your personal data with?” to find out more about these group companies and third party service providers;

• from social media platform providers (such as Facebook, Twitter, Instagram, TikTok, Youtube) where you share our content via social media by liking us on Facebook, then “tweeting” something about us on Twitter;

• otherwise as explained below in this section What personal data do we collect and how do we use it?

Our primary purpose in collecting personal data about you is to: (i) verify your identity and age; (ii) provide you with our services and fulfill requests made by you on the Site, Mobile Applications or in our cinemas; (iii) help us improve our products and services and develop and market new products and services; iv) conduct investigations or resolve disputes; (v) comply with any applicable law, court order, other legal process or regulatory requirements; vi) to enforce our agreements with you; (vii) to protect the rights, property or safety – ours or those of third parties, including our other customers and users of the Site, Mobile Applications and in our cinemas; (viii) provide assistance in providing our Services; and (ix) use as required or permitted by law.

Specifically, we use your personal data for the following purposes:

 

4.1 PERFORMANCE OF PRODUCTS AND SERVICES

We collect and maintain personal information that is voluntarily provided to us when you use our Site, Mobile Applications and/or Services. We use the contact and payment details provided to us so that we can fulfill the delivery of products and services ordered from our Site, Mobile Applications or in our cinemas. We will use the contact information to send you service-related communications about these orders. This includes purchasing products and services, registering for an account with us, participating in our Loyalty Programme, purchasing gift cards/vouchers, your participation in events organized by us or third parties – our partners, your group bookings , hiring our theaters for your own events and processing returns and refunds. For example:

• TICKET RESERVATIONS, GIFTS AND OTHER ONLINE PURCHASES.

If you wish to book tickets through our Site or Mobile Applications, we will need to know your first name, last name, email address and mobile phone number. We may also need this information when you make other purchases through our Site, Mobile Applications. We use this information to process and fulfill your orders and to send you service-related emails about your reservation or purchase.

If you wish to purchase from the Gifts section of our Site, Mobile Apps, you will need to know your name, payment card details and email address, and where you would like us to mail the gift to you, delivery address. When you ask us to send the gift directly to the gift recipient, we will need to know the recipient’s name and delivery address for gifts sent by mail, or the recipient’s name and email address when gifts are sent by email.

If you choose to pay for your purchases on our website by credit or debit card, those payments will be processed by our payment providers and not by Cineland. By clicking, you proceed to payment, understand and accept that: (i) you will leave our Site and be transferred to the payment service provider’s site; (ii) any personal data you enter on the website of the payment service provider VivaWallet will be subject to their privacy policy.

 

What is our legal basis?

We need to use your personal data to fulfill our obligations under any contract we may enter into with you, such as your contract with us for the purchase of your ticket.

4.2 CUSTOMER SERVICE

Our Site, Mobile Apps and our cinemas use various user interfaces that allow you to request information about our products and services: these include printed and electronic inquiry forms, dedicated email addresses, our social media pages and inquiries to cinema staff – in person or by phone. Contact information may be requested on a case-by-case basis, along with details of other personal data relevant to your customer service enquiry. This data is used so that we can respond to your inquiries.

 

What is our legal basis?

It is in our legitimate interest to use your personal data in such a way as to provide you with the best possible customer service.

 

4.3 COMPETITIONS, DRAWINGS AND OTHER PROMOTIONS

From time to time, we may conduct prize draws, prize contests and other promotions on our Site, Mobile Applications, on our social media accounts and/or at our cinema complexes. We may also hold events at other locations. For the purposes of administering such promotions and events, we may process your name, contact details (including email address, postal address and/or telephone number), social media (if applicable) and any other personal information voluntarily provided by you when entering the promotion. For certain contests and events, we may process and publish images, videos, or audio recordings that you voluntarily provide to us.

What is our legal basis?

We need to use your personal data to fulfill our obligations under any contract we may enter into with you (eg the terms and conditions applicable to the promotion) or we have a legitimate interest in using your personal data to enable you to participate in all prize draws, prize competitions and other promotions. We will only use photos we have taken of you at events if we have your consent to do so.

4.4 FEEDBACK ABOUT OUR PRODUCTS AND SERVICES.

From time to time we will contact you to invite you to provide feedback about our products and services in the form of surveys – online or in the cinema. We use this information to help us improve the quality of service provided by our staff and in our cinemas. We also use your feedback to monitor the quality of our products and services, grow our business, and assist in the selection of future product and service lines.

What is our legal basis?

It is in our legitimate business interest to use the information you provide us in your feedback for the purposes described above.

4.5 KNOWLEDGE/AWARENESS AND ANALYSIS OF CUSTOMERS.

We analyze your contact details and other data provided by you while using the Site and our Services with other personal data we collect or observe about you from your interactions with our Site, Mobile Applications, our email messages to you and/ or with our products and services in our salons, such as the products and services you have purchased or viewed.

When you have given your consent (when legally required), we use cookies, log files and other technologies to collect personal data from the computer hardware and software you use to access our Site, Mobile Apps or from your mobile telephone. This includes the following:

• IP address to monitor the traffic and volume of our Site and Mobile Applications;

• session identification number, to track statistical data on the use of our Site and Mobile Applications;

• information about your personal or professional interests, demographics, shopping habits, experience with our products and contact preferences.

Our web pages and emails contain “cookies”, “web beacons” or “pixel tags/tags” (“tags”). Tags allow us to track the receipt of e-mail for you, count users who have visited a web page or opened e-mail, and collect other types of aggregate information. Once you click on an email that contains a Tag, your contact information may subsequently be forwarded to the source of the email and the corresponding Tag.

In some of our email messages, we use a “click-through URL” linked to certain websites and/or Mobile applications administered by us or on our behalf. We may track clicks to help determine interest in specific topics and measure the effectiveness of these communications. Please see our Cookie Policy for further information.

This information is used to create profiles and awareness of your moviegoing habits and the moviegoing habits of our other customers and helps us get to know our customers better.

Using this information, we are able to measure the effectiveness of our content and how visitors use our Site and Mobile Applications and our Services. This allows us to learn which pages on our Site and Mobile Applications are most attractive to our visitors, which parts of our Site and Mobile Applications are most interesting, how customers use our Services, and what offers our customers like to receive.

We also use this information to help us select future product and service lines, design and develop movie theaters, web pages and applications, to identify suitable partners whose offers we can obtain on your behalf as a Cineland customer, and to remember your customer preferences.

We also use this information for marketing purposes (see the Marketing Communications section below for more details).

What is our legal basis?

When your personal information is fully anonymised, we do not seek a legal basis to use it, as the data will no longer constitute personal information governed by data protection laws. However, the collection and use of such anonymized personal data may be subject to other laws that require your consent. Please see our Cookie Policy for more details.

Where your personal information is not in anonymous form, it is in our legitimate interest to use your personal information in such a way as to ensure that we provide the best products and services to you and our other customers.

4.6 MARKETING COMMUNICATIONS

We carry out the following marketing activities using your personal data:

• EMAIL MARKETING

We use the information we observe about you from your interactions with our Site and Mobile Applications, from our email messages to you, and/or with our products and services in our theaters (see the Customer Insights/Awareness and Analytics section above for more details about the information collected and how it is collected) and/or your email address to send you marketing communications by email and text message, in the event that you have consented to receive such marketing communications or we have another legal basis for doing so.

 

What is our legal basis?

Where your personal data is not anonymized, we have a legitimate interest in using your personal data for marketing purposes.

We will only send you marketing communications by email if you have consented to receive such marketing communications or if we are legally entitled to do so.

 

• ONLINE PERSONALIZED ADVERTISING

We use the information we observe about you from your interactions with our Site and Mobile Applications, from our email messages to you, and/or with our products and services in our theaters (see the Customer Insights/Awareness and Analytics section above for more details about the information collected and how it is collected) to provide you with personalized online advertising.

 

What is our legal basis?

Where your personal data is not anonymized, we have a legitimate interest in using your personal data for marketing purposes.

 

• REMARKETING IN SOCIAL MEDIA

We use the information we observe about you from your interactions with our Site and Mobile Applications, from our email messages to you, and/or with our products and services in our theaters (see the Customer Insights/Awareness and Analytics section above for more details about the information collected and how it is collected) to provide you with personalized online advertising on social media channels operated by Facebook/Meta, TikTok and/or Google where you are a registered user of such services.

We do this using Facebook/Meta, TikTok and/or Google client audiences. Please note that this activity requires us to share your encrypted email address with Facebook/Meta, TikTok and/or with Google, which is also a matter of your privacy choices you have made for such services.

What is our legal basis?

Where your personal data is not anonymized, we have a legitimate interest in using your personal data for marketing purposes.

• KNOWLEDGE OF SOCIAL MEDIA

When you are a registered user of Facebook/Meta, TikTok or a Google service, we may use your email address in an encrypted format to enable Facebook/Meta, TikTok and Google to find other registered users of their services who share similar interests with you, based on:

1. the information we monitor about you from your interactions with our Site and Mobile Applications, from our email messages to you and/or with our products and services in our cinemas (see the Customer Insights/Awareness and Analytics section above for more details about the information collected and how it is collected); and

2. the information that Facebook/Meta, TikTok and/or Google maintain about you.

We do this through Facebook Lookalike Audiences and/or, respectively, Google Lookalike Audiences. Please note that this activity is subject to the privacy decisions you have made regarding these services.

What is our legal basis?

Where your personal data is not anonymized, we have a legitimate interest in using your personal data for marketing purposes.

 

• USE OF ANONYMIZED PERSONAL DATA

When your personal data is fully anonymised, we do not seek a legal basis to use it, as the personal data will no longer constitute personal data governed by data protection laws. However, our collection and use of such anonymized personal data may be subject to other laws that require your consent. Please see our Cookie Policy for more details.

4.7 BUSINESS ADMINISTRATION AND LEGAL COMPLIANCE

We use your personal data for the following business administration and legal purposes:

• comply with our legal obligations;

• to protect our business and your profiles/accounts from fraud and other illegal activities;

• to enforce our legal rights or obligations;

• to protect the rights of third parties; and

• in connection with a business transaction, such as a merger, acquisition by another company, or sale of all or a portion of our assets.

What is our legal basis?

When we use your personal data in connection with a business transition, enforce our legal rights or protect the rights of third parties, we have a legitimate interest in doing so. For all other purposes described in this section, we are required by law to use your personal data to comply with any legal obligations imposed on us, such as a court order.

4.8 HEALTH AND SAFETY

We may use your personal data collected for health and safety purposes, including any accident report or accident or mishap registration form that has occurred in one of our cinemas. As this may be data relating to your health, it may fall into special categories of data defined in the relevant data protection legislation as including personal data revealing racial or ethnic origin, religious beliefs and data relating to health ( as well as various others). What is our legal basis?

Alternatively, we may provide you with information about the new or changed purpose and our legal basis for processing it at the time we collect your personal data for that particular purpose.

 

5. HOW DO WE OBTAIN YOUR CONSENT?

In case we use your personal data, your consent is required. You may provide such consent:

• while we collect your personal data by following the instructions provided; or

• by informing us by e-mail, post or telephone using the contact details set out in this Privacy Policy.

The legal basis of consent is only used by us in relation to processing which is entirely voluntary – this consent is not used for processing which is necessary or mandatory in any way.

You can at any time withdraw the specific consent you give to the processing of your personal data by us. For more details, please see the “How to access your personal data and other rights” section below. Please note that even if you withdraw your consent to us using your personal data for a specific purpose, we may continue to rely on other grounds to process your personal data for other purposes.

 

6. USE OF “COOKIES” AND SIMILAR TECHNOLOGIES

Our Site and Mobile Applications use certain cookies, pixels, beacons, logs and other technologies, about which you should be informed. Please see our Cookie Policy to learn more about the cookies we use and how cookies are managed and deleted.

 

7. WHO DO WE SHARE YOUR PERSONAL DATA WITH?

We may share your personal data for the purposes described in Section 4 of this Privacy Policy:

• internally with our employees;

• internally with other companies in our group (meaning our subsidiaries and other companies that are related to Cineland and its subsidiaries); and

• externally with third-party service providers.

The categories of independent service providers (third parties) with which we share your personal data are:

• providers of ticketing systems;

• system providers that help us provide and manage our gift products;

• agencies that provide us with staff at the cinema;

• processing payments;

• printing and delivery companies;

• vendors who host, provide, operate, maintain or administer certain aspects of our Websites, Mobile Applications and customer service/software;

• vendors who host, provide, manage, maintain or administer certain aspects of our IT and business administration systems and data centers;

• providers of customer research and analysis of customer information;

• providers of e-mail, online and social media advertising and other marketing services and systems;

• third parties who help us run or administer competitions or give away prizes;

• third parties who host our events;

• our professional consultants, such as our lawyers, accountants, occupational health and safety consultants and insurance brokers for our business administration and legal purposes;

• any other third party to whom we owe, or are permitted to act, by law, court order or to comply with a subpoena or similar instrument presented to us by any law enforcement, government official or regulatory authority;

• in the event that our business is sold or integrated with another business, our legal and other professional advisors, any legal and other professional advisors of the potential purchaser and any prospective purchaser (subject to confidentiality obligations).

 

8. TRANSFER OF YOUR PERSONAL DATA ABROAD

8.1 WITHIN OUR GROUP

We transfer your personal data within our group as described in section 7.

The use of your personal data is governed by a group agreement and, while we do not routinely transfer your personal data from the EEA to a non-EEA jurisdiction, if we do in the future we will ensure that there is a legal basis for the transfer of personal data outside the EEA , which may include the use of EU “model clauses” approved by the European Commission.

8.2 TO EXTERNAL THIRD PARTIES

Some of the third parties we describe in section 7 may be located outside the EEA or otherwise transfer your personal data outside the EEA.

When we transfer your personal data to external third parties, we take the necessary steps to ensure that your personal information is treated securely and in accordance with this Privacy Policy and all applicable laws.

In relation to the transfer of your personal data outside the EEA, this means that we will ensure that there is a lawful basis for the transfer of personal data outside the EEA. Our standard practice is to use “model clauses” approved by the European Commission for such a transfer. We may also rely on other mechanisms where appropriate, including reliance on third party “binding corporate rules” or the EU-US Privacy Shield.

 

9. LINKS/LINKS TO THIRD PARTIES AND SERVICES

Our Site and Mobile Applications contain links to third-party websites and services, including those of our third-party partners. Please remember that when you use a link/link to go from our Site and Mobile Apps to another website or request a service from a third party, this Privacy Policy no longer applies.

Your browsing and interaction on other websites or your relationship with any third-party service provider is subject to that website’s or third-party provider’s own rules and policies.

We do not monitor, control or endorse the privacy practices of third parties.

We encourage you to familiarize yourself with the privacy practices of any website you visit or third party service providers you engage with and to contact them if you have any questions about their respective privacy policies and practices. privacy.

This Privacy Policy applies only to personal data collected by us through our Site and Mobile Applications and Services, and does not apply to those third-party websites and third-party service providers.

10. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

Whenever we collect or process your personal data, we will usually keep it for one year after our last interaction with you or otherwise in accordance with our data retention policy. We will retain your personal data that you provide to us in connection with any contract we enter into with you for a maximum period of 5 years, subject to the statute of limitations. If your data is useful in the short term, e.g. for specific marketing campaigns, we may delete them. At the end of this storage period, your data will be deleted or anonymized, for example by aggregating with other data, so that it can be used in an undetectable way for statistical analysis and business planning. We monitor the length of time we store your personal data for verification purposes.

 

11. CONFIDENTIALITY AND SECURITY OF YOUR PERSONAL DATA

We are committed to keeping the personal data you provide us secure and will take reasonable precautions to protect your personal data from loss, misuse or alteration.

We have implemented information security policies, rules and technical measures to protect the personal data we control by:

• unauthorized access;

• improper use or disclosure;

• unauthorized modification; and

• unlawful destruction or accidental loss.

All our employees and data processors (ie those who process your personal data on our behalf for the purposes listed above) who have access to and are involved in the processing of personal data are required to respect the confidentiality of personal data data of all users of our Services.

12. HOW TO GET ACCESS TO YOUR PERSONAL DATA AND OTHER RIGHTS?

You have the following rights in relation to the personal data we hold about you. You can exercise these rights by contacting us using the contact details set out in section 3 of this Privacy Policy or in any of the ways described below:

 

• YOUR RIGHT OF ACCESS

If you ask us, we will confirm whether we are processing your personal data and, if so, provide you with a copy of that personal data (together with certain other details). If you require additional copies, we may need to charge a reasonable fee.

 

• YOUR RIGHT TO REMEDY

If the personal data we hold about you is inaccurate or incomplete, you have the right to correct it. If we have shared your personal data with others, we will notify them of the correction if possible. If you ask us, where possible and lawful, we will also tell you with whom we have shared your personal data so that you can contact them directly.

If you have an online account, you can log in and change your contact and email details and text marketing preferences whenever you want.

 

• YOUR RIGHT TO ERASURE

You can ask us to delete or remove your personal data in some circumstances, for example when we no longer need it or if you withdraw your consent (where applicable). If we have disclosed your personal data to others, we will notify them of the deletion if possible. If you ask us where it is possible and legal for us to do so, we will also tell you who we have shared your personal data with so that you can contact them directly.

  You can also delete your account at any time in your account on our Site and Mobile Applications, which will automatically delete your personal data from our systems. We do not keep a copy of them in any way and cannot recover them if you choose to do so. Note that deleting your account will also delete your bonuses, gifts, club points, gift vouchers and other benefits that we have given you as attached to your profile. Once deleted, an account cannot be recovered.

• YOUR RIGHT TO RESTRICT PROCESSING

You can ask us to “block” or prevent the processing of your personal data in certain circumstances, such as when you dispute the accuracy of that personal data or object to us processing it. However, this will not prevent us from storing your personal data. We’ll tell you before we remove any restrictions. If we have shared your personal data with others, we will notify them of the restriction where it is possible for us to do so. If you ask us, if it is possible and lawful for us to do so, we will also tell you with whom we have shared your personal data so that you can contact them directly.

 

• YOUR RIGHT TO DATA PORTABILITY

As of 25 May 2018, you have the right in certain circumstances to receive the personal data you have provided to us (in a structured, commonly used and machine-readable format) and reuse it elsewhere or ask us to transfer it to a third party of your choice.

• YOUR RIGHT TO OBJECT

You can ask us to stop processing your personal data and we will do so if:

1. we rely on our legitimate interests or someone else’s legitimate interests to process your personal data, unless we can demonstrate compelling legal grounds for the processing; or

2. we process your personal data for direct marketing.

You can ask us to stop sending you marketing communications sent to you by email at any time by using the “opt out” or “unsubscribe” link that we will provide you with in the marketing message. Where our legal basis for processing your personal data for electronic direct marketing purposes is your consent, your objection to processing will be deemed to be a waiver of your consent for that purpose. Please note that it may take us a few days (but usually no more than 14 days) to ensure that our marketing systems are up to date, and during this period you may still receive marketing communications from us.

• YOUR RIGHTS REGARDING AUTOMATED DECISION MAKING AND PROFILING

You have the right not to be subject to a decision based on automatic processing involving profiling if it leads to a legal consequence or significantly affects you in a similar way, unless such profiling is necessary for the conclusion or performance of a contract between you and us.

• YOUR RIGHT TO WITHDRAW CONSENT

If we rely on your consent (or express consent) as our lawful basis for processing your personal data, you have the right to withdraw that consent at any time.

• YOUR RIGHT TO COMPLAINT WITH THE SUPERVISORY AUTHORITY

13. CHANGES TO THIS PRIVACY POLICY

To ensure that you are always informed about how we use your personal data, we will periodically update this Privacy Policy/Privacy Policy to reflect any changes to our use of your personal data. We may also make changes if necessary to comply with changes in applicable law or regulatory requirements. We will post any changes on our Site to keep you informed. However, we recommend that you periodically review this Privacy Policy to stay informed about how we use your personal data.

This cookie policy (“Cookie Policy”) aims to inform you how Cineland uses cookies and similar technologies to assist you in making informed decisions when using our Site and Mobile Applications. Please take a moment to read and understand this cookie policy. This cookie policy should also be read in conjunction with our Privacy Policy and our General Rules.

Cookies and similar technologies are very small text documents or pieces of code that often include an anonymous unique identifier.
